Australian Workplace Agreements & Individual Transitional Employment Agreements (ITEAs)

An Australian Workplace Agreement - AWA - is an individual written agreement which lists the terms and conditions of employment between an employer and employee under the Australian Workplace Relations Act of 1996.

Because an AWA has the ability to override employment conditions in state or territory laws with the exception for occupational health and safety, workers’ compensation or training arrangements, it is essential that you have your contracts reviewed.

An AWA must meet the minimum Australian Fair Pay and Conditions Standards. Agreements must include a dispute resolution procedure, and may not include prohibited content. Agreements are for a maximum of five years. The need to be approved, promoted and registered by the Workplace Authority.They operate to the exclusion of any award and prohibit industrial action regarding details in the agreement for the life of the agreement.

ITEA

An individual transitional employment agreement (ITEA) is a new type of instrument which is available for limited use during the transition to the Government’s new workplace relations system. An ITEA can only be made until 31 December 2009.

This includes things like the rate of pay, hours of work and other things relating to the employee’s job.

An ITEA will be assessed against the no-disadvantage test (NDT) to ensure that it does not disadvantage the employee against an applicable collective agreement or applicable award.
